By accessing or using Surgepulse Studio ("the Service"), you agree to be bound by these Terms of Service, our Privacy Policy, and our Cookie Policy. If you do not agree to all terms, do not use the Service. We reserve the right to modify these terms at any time — continued use after changes constitutes acceptance.
You are responsible for maintaining the security of your account credentials. You must provide accurate registration information including a valid first name, last name, and email address. You agree not to share your account or use another person's account. You are liable for all activity under your account, including websites published under your subdomains.
Surgepulse Studio offers four subscription tiers: Free, Starter ($9/mo), Pro ($19/mo), and Enterprise ($49/mo). Each plan includes specific limits on:
Payment processing: All payments are processed securely by Stripe. By subscribing to a paid plan, you authorize Stripe to charge your payment method on a recurring monthly basis until canceled.
Upgrades & downgrades: Plan changes take effect immediately. When upgrading, you are charged the prorated difference. When downgrading, the new rate applies at the next billing cycle.
Cancellation: You may cancel your subscription at any time via the Billing & Plan section or Stripe Customer Portal. Upon cancellation, you retain access to paid features until the end of your current billing period. After that, your account reverts to the Free plan. Your websites and content are preserved.
You may use Surgepulse Studio to create, edit, and publish websites for lawful purposes. You agree not to:
The AI Site Builder uses Anthropic's Claude API to generate website content from your text prompts. By using this feature, you acknowledge that:
Your content: You retain full ownership of all content you create, including AI-generated content you accept and publish. By publishing through our platform, you grant us a limited, non-exclusive license to host, display, and serve your content as necessary to operate the service.
Code export: When you export your site code (HTML bundle, separate files, or ZIP), the exported output is yours to use without restriction.
Our platform: Surgepulse Studio's code, design, built-in templates, editor components, and brand assets are our intellectual property. Built-in templates may be used and customized for your published sites but may not be redistributed as templates.
Published sites are accessible at yourslug.surgepulse.org. You are responsible for all content published under your subdomain. We reserve the right to unpublish or remove sites that violate these terms. Subdomain slugs are assigned on a first-come, first-served basis and may not impersonate other brands, individuals, or organizations.
We strive for 99.9% uptime but do not guarantee uninterrupted service. Scheduled maintenance, unforeseen outages, and force majeure events may affect availability. We will make reasonable efforts to notify users of planned downtime. Current system status is available at our Status Page.
You may delete your account at any time from your profile settings. We reserve the right to suspend or terminate accounts that violate these terms. Upon termination, your website content will be permanently deleted after a 30-day grace period. Active paid subscriptions will be canceled through Stripe, and no further charges will be applied.
Surgepulse Studio is provided "as is" without warranties. We are not liable for indirect, incidental, or consequential damages arising from use of the service, including data loss, business interruption, AI-generated content issues, or third-party claims.
Any disputes shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, conducted by a single arbitrator in Wilmington, Delaware.
These Terms shall be governed by the laws of the State of Delaware, United States. Arbitration shall be limited to the dispute between you and Surgepulse Studio individually and shall not be consolidated with any other proceedings.
Before initiating arbitration, both parties agree to attempt informal resolution by contacting legal@surgepulse.org. If not resolved within 30 days, either party may proceed with arbitration.
You agree to indemnify and hold harmless Surgepulse Studio from any claims, damages, losses, or expenses arising from: (a) your use of the Service; (b) content you create, publish, or distribute; (c) your violation of these Terms; or (d) your violation of any third-party rights. This obligation survives account termination.
These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Surgepulse Studio. If any provision is held invalid, the remaining provisions continue in full force.
